By accessing our Site, you consent to these Terms of Service (“Terms”) and our collection, use and sharing of your information as described in our Privacy Policy, or any other terms linked to these Terms. 5. Annual Enrollment Helpline Trademarks

Annual Enrollment Helpline trademarks, including the trademarks “MedicareHelpLine,” “HealthPlanSolution,” “LifeInsuranceSavings”, “InsuracePlanSolutions”, ”BurialExpense”, logos, all page headers, graphics, images, symbols, trade names and other Annual Enrollment Helpline marks found at the Site are the proprietary property of Annual Enrollment Helpline (collectively the “Marks”). Use of the Marks is strictly prohibited without the prior written consent of Annual Enrollment Helpline.

6. Third Party Trademarks

The trademarks of third parties may also appear on the Site from time to time; you may not use these trademarks without prior written permission of their respective owners. You acknowledge and agree that nothing on the Site grants, expressly or implicitly, by estoppel or otherwise, any right or license to use any of these trademarks, nor may anything be construed to mean that Annual Enrollment Helpline has authority to grant any right or license on behalf of any third-party trademark owner.

Annual Enrollment Helpline has no obligation to monitor your interaction with the Site, but reserves the right to review ‎or monitor the Site and any user submissions in its sole discretion.

You hereby ‎agree to ‎indemnify the Annual Enrollment Helpline Parties from and against any and all claims, liabilities, and ‎expenses ‎‎(including reasonable attorneys’ fees), resulting from your use of the Site or any ‎breach of ‎these Terms by you.‎

10. Ability to Accept Terms

You affirm that you are the age of majority in your jurisdiction and are fully able and competent to ‎enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth ‎in these Terms, and to abide by and comply with these Terms. Annual Enrollment Helpline processes data in the United States, and we make no representation that this Site is appropriate or available for use beyond the United States. If you use this Site from other locations, you are doing so on your own initiative and are responsible for compliance with applicable local laws regarding your online conduct and acceptable content, if and to the extent local laws apply. This Site may describe programs and services that are available only in the United States (or only parts of it). We reserve the right to limit the availability of this Site and/or the provision of any content, programs, service, or other feature described or available on this Site to any person, entity, geographic area, or jurisdiction, at any time and in our sole discretion, and to limit the quantities of any content, program, service, or other feature that we provide.

12. Choice of Law and Forum

These Terms will be governed by and construed in accordance with the laws of the State of Kansas, ‎without giving effect to any principles of conflicts of law. All disputes arising under, or in any way connected with use of this Site, shall be litigated ‎exclusively in the state and federal courts residing in the State of Kansas, and in no other ‎court or jurisdiction. You hereby submit to the jurisdiction of the state and federal courts ‎sitting in the Overland Park, Kansas.

13. Severability and Enforceability

If any provision or portion of these Terms is held to be illegal, invalid, or unenforceable, in whole or in part, it shall be modified to the minimum extent necessary to correct any deficiencies or replaced with a provision which is as close as is legally permissible to the provision found invalid or unenforceable and shall not affect the legality, validity or enforceability of any other provisions or portions of these Terms.

15. User Suggestions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other ‎information provided by you to Annual Enrollment Helpline through the Site are not confidential and you grant us a ‎worldwide, perpetual, royalty-free license to distribute, publish, modify, edit or otherwise use your ‎submissions. Annual Enrollment Helpline shall be entitled to the unrestricted use and dissemination of these ‎submissions for any purpose, commercial or otherwise without any acknowledgement of or ‎compensation to you.

We may revise these Terms at any time, with or without notice, by updating this page, and such ‎revisions will be effective upon posting to this page. 19. Product Restrictions

Policies and products are not available in all states. Exclusions and misstatement and misrepresentation restrictions may apply. The quote, policy and plan comparisons and information we provide are furnished by the individual insurance companies, and are subject to change without notice and/or underwriting qualification by the specific insurance company to which the application is submitted. A quote should not be construed as a commitment from the insurance company to actually issue that policy or any other policy to you. All quotes that we present are based on the information you have provided us at our request. You are responsible for ensuring that information you provide in connection with any quotation or inquiry through the Site is accurate and up to date. You may change or edit your information at our Site by contacting us via email at clientservices@annualenrollmenthelpline.com.

To purchase an insurance policy, you must submit a completed application to the insurance company, which will then review and underwrite your application along with any other information that may be gathered from sources such as, but not limited to, the Department of Motor Vehicles, credit bureaus and the Medical Information Bureau. Following that review and underwriting analysis, the insurance company will then determine whether you are eligible for insurance and, if so, the precise premium to charge you for the insurance policy you seek. This underwriting process may result in higher or lower premiums than your quote.
